Terms and Rental Conditions Villa Euphoria

Article 1: General

1. The following general conditions apply to all bookings for the holiday home “Villa Euphoria” located in Kyrianna, Crete.

2. The tenant is also understood to mean a tenant, tenants.

3. The owner is understood to mean the owner of the holiday home to be rented.

4. The administrator shall mean the contact person designated by the owner in Crete, Greece.

Article 2: Conclusion of the agreement

a. Pre-Contractual phase:

1. Reservation of the holiday home is done via the internet, by email or by telephone.

2. After the reservation request, the tenant will receive an option of 7 calendar days on the requested holiday period via email. In this email, the payment options are described to definitively reserve the holiday period during the option. In case of a non-payment within 7 calendar days, the tenant will be informed by email that the option will be cancelled.

b. Agreement

The lease is concluded after the owner has received the (first) payment. The agreement is final and binding after the (first) payment. Cancellation charges are due in case of cancellation. The payment of the advance is accepted as acceptance of the rental conditions.

Article 3: Payment

1. Within 7 calendar days after the option confirmation, 50% of the total rental amount must be paid in the owner’s bank account.

2. The remaining rental amount and the deposit must be paid to the owner’s bank account no later than 6 weeks before departure.

3. For reservation less than 6 weeks before departure, the entire invoice amount must be paid immediately upon receipt of the option confirmation.

4. In the event of late payment of amounts due, the owner will send a written reminder in the form of an email. If the amount due is not yet in the possession of the owner within 7 days after the date of the reminder, the agreement will be deemed to have been canceled. The owner will charge a cancellation fee as defined in article 8 of these terms.

Article 4: Use of the house

The house can be rented for a maximum of 4 persons.

Upon arrival in the holiday home, the tenant must inspect the holiday home and immediately report any visible deficiencies to the owner or the administrator. Visible deficiencies, such as an unclean holiday home or part of it, can only be reported on the day of arrival.

The tenant must inhabit the holiday home as a good house father and respect the internal rules.

Deficiencies that arise during the stay should be reported immediately to the administrator or owner.

In the house there is an absolute no smoking policy and pets are not allowed.

The owner / manager can refuse tenants or have them leave the house if they want to live in the holiday home with more people than allowed, if they have a pet with them, or if they smoke within the holiday home.

The holiday home has a private swimming pool. We ask you to use the outdoor shower before going into the water. Allow at least 15 minutes to elapse after the (re) use of sunscreen for your next swim. After all, intensive use of the pool in combination with just applied sunscreen can lead to cloudy water.

Linens and bedding (sheets, towels, tea towels, duvets and pillows, beach sheets) are present in the holiday home.

The rental price of the holiday home includes water, electricity, air conditioning, wifi, internet, dishwasher, dishwasher tablets, washing machine product.

The holiday home does not have a charging station for electric or plug-in hybrid cars, but it is allowed to charge via the regular socket. When renting an electric or plug-in hybrid car during your stay, additional electricity costs above a daily consumption of € 5.00 will be deducted from the extra deposit. (for the amounts, see Article 12)

Check-in at the property can be on the day of arrival from 14 am. The house must be left on the day of departure at 10 am. The tenant can apply for a derogation for both arrival and departure. The owner allows this for free as far as this is possible according to occupancy rate and the planned villa management and maintenance.

Article 5: Intermediate cleaning

An intermediate cleaning and changing of the kitchen, linen and bedding can be requested optionally.

The linens are provided with extra sets in the house which you can also wash yourself. At the end of your stay, a minimum of one set must be cleaned back in the cabinets.

The pool water is tested and maintained 3 times a week.

Article 6: Final cleaning and review

Final cleaning is compulsory and not included in the rental price. The administrator has the right to charge an additional fee if the following items are not carried out by the tenant when leaving the holiday home.

Even though at the end of the holiday it is cleaned by a cleaning service or by the owner, the house must be left clean and with a brushed floor: kitchen, toilet, shower should be left hygienically. The dishes should be clean. The garbage must be removed.

Moved furniture should be restored back to the original place.

Article 7: Deposit

1. The deposit must be paid to the owner prior to the stay.

2. The deposit is higher if you use an electric car or plug-in hybrid during your stay.

3. The deposit will be refunded to the tenant no later than 14 days after the end of the stay, minus any costs incurred by the landlord for damage or replacements and / or extra electricity consumed due to renting an electric car or plug-in hybrid above the planned daily amount per night stayed.

4. The renter undertakes to pay any additional costs for consumed electricity due to renting an electric car or plug-in hybrid on top of the total deposit amount within 14 calendar days after the receipt of the bill received into the account of the lessor.

Article 8: Cancellation by tenant

1. Any cancellation must be made known in writing to the owner. This can be sent via email to info@villa-euphoria-kreta.be.

2. In the case of cancellation of the lease by the tenant, the following cancellation fee will be charged:

a) in case of cancellation more than 6 weeks before the start of the booked stay, an amount of 50% of the total rental amount is payable.

b) if cancelled from 6 weeks to 30 days before the start of the booked stay, an amount of 75% of the total rental amount is payable.

c) in case of cancellation within 30 days before the start of the booked stay, the total rental amount is payable.

3. In the early termination of the stay, the full amount of the rental will be payable.

4. A cancellation insurance is recommended.

5. An exception is provided if the tenant cancels due to COVID-19 travel restrictions due to his own or the Greek government so that his / her holiday in villa Euphoria cannot take place. In the event of invoking such cancellation by the tenant, the owner will refund the full amount as soon as possible.

Article 9: Termination or modification by the owner

1. The owner may only terminate or amend the lease in the following cases:

In case of force majeure such as a natural disaster, extraordinary weather conditions, fire, war, or death of the owner.

2. In the above case, the owner will notify the tenant as soon as possible.

3. In the event of invoking a force majeure situation by the owner, the full amount will be refunded as soon as possible.

4. Any other damage as a result of the cancellation or modification will not be compensated by the owner.

Article 10: Liability

1. The owner assumes no liability for:

a) theft, loss or damage of any kind, during or as a result of a stay in our holiday home;

b) the uncompleted or inaction of technical equipment in the dwellings, temporary failures or malfunctions in and around the holiday home of water and/or energy management;

c) failure or partial execution of the lease agreement in the event of force majeure as set out in article 9;

2. In the case of accidents in or around the house, the owner or the administrator cannot be held liable.

3. The tenant is jointly and severally liable for all loss and / or damage to the rented property and its inventory, regardless of whether this is the result of acts or omissions of the tenant or of third parties who are in the rented property with the tenant’s permission.

4. Additional costs may be charged to the tenant for improper use or incorrect abandonment of the rented property.

Article 11: Miscellaneous amounts & costs

The deposit is € 200 per stay.

If you rent an electric car or plug-in hybrid during your stay, an additional € 200 deposit will be requested as an advance on the electricity bill for the transport.

Mandatory final cleaning € 95 per stay

Mandatory maintenance of bed, bath and kitchen linen € 15 per person per stay

An interim cleaning is € 75 + € 15 per person (only at the request of the tenant)

Article 12: Electricity use for rental cars

The renter informs the lessor as soon as possible what kind of car he will rent or rent during his stay.

These provisions only apply if the tenant rents an electric or plug-in hybrid.

It is allowed that the car is charged with electricity from the holiday home, but we charge the electricity consumed via a basic formula.

Upon your actual arrival and effective departure, we ask that you send us a photo of the meter reading of the electricity meter.

In the absence of this, the meter readings of the electricity will be used by the house manager at the start and departure of your stay. However, this is not always exactly at the time of your arrival or departure, as you can check in and check out completely yourself.

The total calculated amount of electricity consumed during the stay is reduced by € 5.00 (*) per night stayed.

Basic formula for calculating electricity car :

KWh consumed x monthly rate

.vb. month February 2023 – stay 10 nights – consumption 600 KWh

supplement = (600 x 0,211) – (5 x 10) = 126,6 – 50 = 76,6 euro

The calculation is only based on the basic rate for electricity consumption. The calculations do not take into account the many other taxes and benefits that apply to the Greek electricity bill. These remain at the expense of villa Euphoria.

(*) Villa Euphoria provides today € 5,00 euro per booked night. In practice, villa Euphoria in 2023 will carry double the average daily consumption in villa Euphoria over the 6 summer months of 2022.

If it is found that the tenant is staying in the house with an electric car or plug-in hybrid without having made this known in advance, the extra deposit is immediately payable to the landlord. The tenant will also pay € 50 non-recoverable compensation per day of stay started.

The owner / manager can refuse tenants or cause them to leave the house if they rent the holiday home without having previously indicated that they are renting an electric or plug-in hybrid car and / or do not pay the provided extra deposit and / or fixed compensation to be paid.

Article 12: Complaints

1. Despite the efforts of the owner and the administrator, you may consider that you have a legitimate complaint regarding the rented holiday home. In order to maintain your possible claims for damages or refunds, you must provide the owner at all times with the opportunity to provide an appropriate solution for the complaint. An early departure or the independent involvement of another holiday home frees the owner of any indemnity obligation.

2. If the complaint found cannot be resolved on the spot with the manager, you should contact the owner as soon as possible. The owner will endeavor to resolve the complaint to the satisfaction of the tenant, as far as this is within its capabilities.

3. If the complaint cannot be resolved satisfactorily on the spot, this complaint must be submitted to the owner again in writing and motivated within 4 weeks after your departure from the holiday home. This can be emailed to info@villa-euphoria-kreta.be
